OFFICIAL RULES AND REGULATIONS

IMPORTANT: PLEASE READ THESE OFFICIAL RULES AND REGULATIONS (THE “CONTEST RULES") BEFORE ENTERING THE 2024 “LANDSHARK SUMMER ON-PACK ‘FIN TO WIN’” CONTEST (THE “CONTEST”). BY PARTICIPATING IN THE CONTEST, AN ENTRANT REPRESENTS THAT HE/SHE/THEY SATISFY ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREE TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES AND ALL DECISIONS OF CARLSBERG CANADA INC. (THE “CONTEST SPONSOR”) IN RELATION TO THE CONTEST.

THIS CONTEST IS OPEN TO CERTAIN CANADIAN RESIDENTS. MUST BE OF LEGAL DRINKING AGE AND A RESIDENT OF AN ELIGIBLE PROVINCE OR TERRITORY TO PARTICIPATE.

1. CONTEST PERIOD

The eligibility period for entering the Contest opens at 12:01 AM (EST) May 20, 2024 and continues until 11:59 PM (EST) on August 16, 2024 (The “Contest Period”).

2. ELIGIBILITY

The Contest is open to residents of British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, New Brunswick, Nova Scotia, Newfoundland & Labrador, and the Northwest Territories (the “Contest Provinces”) who have reached the legal drinking age in their province or territory of residence. 

To be eligible to win, an entrant must not be an employee of, or a member of the immediate family of an employee of, or domiciled with an employee of any of the following: (a) any Provincial liquor control board or other agency responsible for the regulation of liquor products in any of the Contest Provinces; (b) the Contest Sponsor or any of its parent companies, subsidiaries or affiliates; (c) any Contest judges; (d) any prize supplier; or (e) any advertising or promotion agency which has provided or is providing services in relation to the Contest.

3. HOW TO PLAY

To enter into the Contest you may either: (a) Submit on-line at www.landsharklager.ca/fintowin a PIN number that has been included inside each specially marked 24x355mL can packs, 15x355mL can packs, 6x473mL can packs of Landshark Lager or use your smartphone to scan the QR CODE located on the pack and provide your name, age, address (including city, province and postal code), e-mail address, and day and evening telephone numbers; or (b) No purchase necessary; receive a unique pin code by submitting a letter describing what “fins up” means to you, along with your name, age, address (including city, province and postal code) e-mail address, plus day and evening telephone numbers. Submissions may be made via email to [email protected]  or submitted through mail to Carlsberg Canada Inc. at 102-1425 North Service Road East, Oakville, Ontario, L6H 1A7 address to the attention of: LandShark Marketing “LANDSHARK LAGER FIN TO WIN CONTEST”. All entries must be received before August 16, 2024 (“The Contest Closing Date”) and must be readily legible. The Releasees (as defined below) take no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Contest entry requests. 

A maximum of (1) one entry per day, will be permitted. To be eligible for the Grand Prize draw, eligible entries must be before the Contest Closing Date. All eligible Entries received during the Contest Period will be eligible for the prize draw. 

All entries are subject to verification. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification). Failure to provide such proof in a timely manner may result in disqualification.  The sole determinant of the time for the purposes of determining whether a Contest entry is valid is the Contest Sponsor. An entry will be rejected if, in the sole and absolute discretion of the Contest Sponsor, it is not fully completed with all required information and submitted during the Contest Period. Any use or attempted use of any automated, macro, script, robotic or other systems(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and grounds for disqualification by the Contest Sponsor. The Releasees (as defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries (all of which are deemed void).

4. PRIZES

Odds of winning any prize depend on the number of eligible entries received prior to the applicable draw(s). There will be one thousand (1000) prize(s) available to be won in the Contest.

(The Instant Prizes and Premium Prizes are referred to each as a “Contest Prize” and collectively as the “Contest Prizes”)

The following conditions apply to the Contest Prizes: (a) each Contest Prize must be accepted as awarded and is not transferable (no substitutions except at Contest Sponsor’s discretion); (b) any costs associated with delivering a Contest Prize to a selected entrant are the sole responsibility of such entrant provided, however, that the Contest Sponsor may elect to pay for any customary and reasonable shipping costs associated with the delivery of a Contest Prize; (c) Contest Sponsor reserves the right at any time, in its sole and absolute discretion to: (i) place reasonable restrictions on the availability or use of any Contest Prize or any component thereof; and (ii) substitute the Contest Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, a cash award. 

5. PRIZE WINNER SELECTION

“Instant Prize” winners will be selected at random throughout the Contest Period. 


The random draw for the “Premium Prizes” will be held at approximately 9:00 AM (EST) on August 23, 2024 (the “Draw Date”), to choose one hundred (100) selected entrants from all eligible entries received during the Contest Period. The draw will be conducted by an independent organization from all eligible entries received as of the end of the Contest Period. 


6. WINNER NOTIFICATION

The Contest Sponsor or its designated representative will make a maximum of three (3) attempts to contact each selected entrant via the contact information provided by the selected entry within five (5) business days of the Draw Date. If a selected entrant cannot be contacted within three (3) attempts or five (5) business days of the Draw Date (whichever occurs first), or if there is a return of any notification as undeliverable; then the selected entrant will be disqualified (and will forfeit all rights to the applicable Contest Prize) and the Contest Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries (in which case the provisions of this section shall apply to such new selected entrant). 

Before being declared a winner of any Contest Prize, the selected entrant will be required to correctly answer a mathematical skill-testing question without mechanical or other aid, and sign and return within five (5) business days of notification the Contest Sponsor’s declaration and release form, which: (i) confirms compliance with these Contest Rules; (ii) acknowledges acceptance of the applicable Contest Prize as awarded; (iii) releases the Contest Sponsor and each of its affiliates, and their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of the applicable Contest Prize or any portion thereof; (iv) agrees to the publication, reproduction and/or other use of the selected entrant’s name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Contest Sponsor or any of its affiliates or designated representatives, in any manner whatsoever, including print, broadcast or the internet. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest release form within the specified time; and/or (c) cannot accept the applicable Contest Prize for any reason, then he/she will be disqualified (and will forfeit all rights to the applicable Contest Prize) and the Contest Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible entries (in which case the forgoing provisions of this section shall apply to such new selected entrant). 

7. LIMITATIONS OF LIABILITY

Without limiting the release provided in Section 6 above, and for greater certainty, the Releasees will not be liable for: (a) any incomplete or inaccurate information, whether caused by users of the Contest website or by any equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; (b) the theft, destruction or unauthorized access to, or alteration of, entries or the Contest website; (c) any problems with, or technical malfunctions of, telephone networks or lines, computer systems, servers or providers, computer equipment, software, viruses or bugs; (d) any failure of any entry or other communication required hereunder to be received by the Contest Sponsor or entrant, as applicable, for any reason, including, without limitation, traffic congestion on the Internet or at any website or combination thereof; or (e) damage to a participant’s or other person’s system occasioned by participation in this Contest or downloading of materials related to this Contest.

The provincial liquor authorities are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever with regard to any matter that relates to the Contest. The Contest is in no way sponsored, endorsed, or administered by, or associated with, Facebook, Instagram, or X.

8. PERSONAL INFORMATION

By entering this Contest, entrants consent to the collection, use and disclosure of their personal information to the Contest Sponsor for the purposes of administering the Contest and in accordance with the Contest Sponsor’s Privacy Policy (available at: www.carlsberg.ca/en/privacy) (the “Privacy Policy”). By accepting a Contest Prize, the recipient consents to the collection, use and disclosure to the public the following information: their name, address (city, province), voice data (including verbal/recorded statements), statements (whether written or otherwise), and photographs or other likenesses for publicity purposes in connection with the Contest in any media or formats including, without limitation, the internet, television, print media, and radio, without further notice, permission or compensation. Personal information will not be used for purposes other than administering the Contest and the other purposes described herein and will not be disclosed to any third-party unless required for the purpose of administering the Contest and/or awarding a prize to an eligible entrant.

9. MISCELLANEOUS

All decisions of the Contest Sponsor and its designated representative(s) are final and binding in all matters relating to this Contest and on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries. The Contest Sponsor and other Releasees will not be responsible for illegible, incomplete, postage-due, lost, misdirected, errors, failures, or late entries, all of which will be deemed void. Any use of automated devices to enter this Contest is prohibited. No correspondence will be entered into except with selected entrants. Contest is subject to all applicable federal, provincial, and municipal laws. In the event of a dispute regarding who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address associated with the applicable entry at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access service provider, email service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A selected entrant may be required to provide the Contest Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The Contest Sponsor reserves the right, at its sole and absolute discretion to disqualify from this Contest and any future contest or other promotion conducted by the Contest Sponsor, any individual that they deem not in compliance with these Contest Rules, to be tampering with the entry process or the operation of the Contest or Contest website; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

PIN numbers that are obtained from unauthorized sources, are not original, or are illegible, altered, reproduced, stolen, counterfeit, irregular, or contain printing or other errors are not valid. The Contest Sponsor is not responsible for lost, falsified or ineligible PIN numbers. All decisions of the Contest Sponsor are final. The Contest Sponsor assumes no responsibility for any errors in the offer or administration of this Contest, including, but not limited to, errors in advertising, the Contest Rules, the selection and announcement of winners or the distribution of Contest Prizes. The Contest is subject to and intended to comply with all applicable federal, provincial, and municipal laws, and to the extent any provision of the Contest does not comply with such laws such provision shall be void. By entering the Contest, entrants agree to abide by the Contest Rules and decisions of the Contest Sponsor which are final.

10. RIGHT TO TERMINATE OR AMEND

The Contest Sponsor reserves the right to terminate or amend this Contest and or amend these Contest Rules, in whole or in part, at any time and without prior notice if any factor interferes with its proper conduct as contemplated by these Contest Rules.

11. INTELLECTUAL PROPERTY

All intellectual property used by the Contest Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, artwork, web pages, source code, drawings, illustrations, slogans and representations are owned by or licensed to the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.
